How Long Do I Have to File a Personal Injury Lawsuit?
Time limits in personal injury cases can be complicated so the best way to ensure they are met is to contact a personal injury lawyer as soon as possible after an accident occurs. The time limit for filing a lawsuit in a typical personal injury case, such as in car accidents or slip and falls, is ordinarily 2 years from the date of the incident. (Cal. Code Civ. Pro § 335.1).
However, this time limit may be shorter when a governmental entity is involved. In such cases a government claim (sometimes called a “precursor to a lawsuit”) must be filed within 6 months from the date of the incident.
Another situation in which the time may be shorter is a case for medical malpractice. In such cases, the time limit is 1 year from the date the injury was discovered or a maximum of 3 years. (Cal. Code Civ. Pro. § 340.5).
